(EMAILWIRE.COM, May 22, 2012 ) Houston, TX -- In light of New York’s recent decision to adopt no-fault divorce, Houston attorney John K. Grubb reaffirms his support for no-fault divorces, and continues to handle cases in Texas under the no fault distinction, one that places no blame on either party for the divorce. He encourages citizens to keep the courts free of at fault divorces, which have not been tried in Texas in 40 years.

Texas adopted the “no fault” divorce practice in 1972, before which one party had to legally be named “at fault” for the split in order for divorce to be an option. In Texas, no fault divorce is called “insupportability,” meaning that the union, for whatever reason, is damaged beyond reconciliation. This avoids assigning legal blame, which can be a distraction from the legal purpose of a divorce, to divide two people’s legal property in a fair and complete manner.
“When I’m handling divorce cases, I try to proceed on the assumption that I am dealing with two good and decent people,” Grubb said. “One or both of them have made the decision to proceed without their spouse, and both deserve the opportunity to end their marriage with a degree of grace and dignity. Even when fault is involved in many cases it is better not to use it as a grounds for divorce. Sometimes it is just going to make a bad situation worse.”
